1. Scope of this terms & conditions
Those general terms & conditions apply for all business relations between ExoFood e.U. and their private customers in the version for the time being.

2. Conclusion of contract
The presentation of the variety of goods in our online shop does not represent an offer as defined by § 861 ABGB. They are without obligation. Through the online shop the private customer is invited to deliver an offer for the conclusion of a sale agreement. With the dispatch of the order through the private customer the contract is not completed. The private customer will receive an order confirmation via email. Thus order confirmation is no acceptance of the order. Thus order confirmation should inform the private customer that the order has been received by ExoFood e.U.
The contract with ExoFood e.U. will be completed if ExoFood e.U. accepts the offer from the private customer and will dispatch the products. In this case the private customer will receive a shipment confirmation. The contract will be stored by ExoFood e.U.

3. Right of cancellation and returns policy
As our valued customer you have the unconditional right to cancel your contract within 14 working days of delivery, without being obliged to state any reasons. To comply with this time limit, all you need to do is to either return the goods bought online or send a return request within the 14-day period by post or email to:

In case of cancellation of the contract the full or partial purchasing price will only be returned one after the replacement of the goods. The cost of the replacement of the goods will be at the expenses of the private customer.
The goods should be returned unopened. If goods are impaired we will impose an adequate value.

4. Warranty and liability
Perishable goods must be stored cooled. As we are selling perishable goods we could only replace them if any defects are claimed right after delivery. The customer has to control the condition of the goods if the packaging is obviously damaged. If the goods are damaged the customer has to refuse the delivery.
Apart from the above mentioned exclusion we reserve the right to fulfill the warranty claim from all other goods in our web shop by our choice either through improvement, replacement or reduction of price. The customer has to prove that the defect has existed at the moment of delivery. Hidden defects have to be reproved right after their detection. If a notice of defect has not been raised or has been raised to late, the goods are applied as approved. The enforcement of a warranty claim or claim of damage as well as the right of avoidance for mistake based on defects are excluded in this cases. The implied warranty in Austria for mobile goods is two years and for unmovable goods three years. The period of warranty starts after the complete delivery of the goods.

5. Prices and delivery costs
Only the prices at the moment of the order will count. All prices include the VAT.
If the private customer places an order over the amount of EUR 60.00 we won`t charge delivery costs within Austria. Under the amount of EUR 60.00 we will charge a delivery cost lump sum in the amount of EUR 5.60 per delivery, independent of the size or weight of the order.

6. Delivery
ExoFood e.U. will dispatch the goods to the specified address from the order.
Within the European Union we will deliver duty paid. For deliveries in countries outside of the European Union (especially Switzerland) the customer is liable for all customs, taxes, duties or other fees which may apply.
If an ordered good is not available, we will dispatch the remaining goods. As soon as the product, which was not available is available again we will send it to the customer. Additional delivery costs apply. Please mention within the order if this is undesired. In this case the delivery is held back until all ordered goods are available.
If there is a delay in delivery we will contact you immediately.

7. Reservation of proprietary rights

Until the complete payment, the goods are the property of ExoFood e.U.

8. Payment, payment date, delay of payment
The payment of the goods could occur via PayPal (credit card) or via advanced payment. In individual cases ExoFood e.U. reserves the right to accept only a special method of payment. The payment via sending cash or a cheque is not possible. We are not liable in case of loss.

Payment via advanced payment
By payment via advanced payment the customer will receive an email with the invoice and the bank details. The money transfer has to occur within 10 work days. Otherwise the order will be cancelled.
By encashment of a voucher please pay attention to the specific terms of encashment, like minimum order quantity, validation, and so on. In either case only one voucher per order can be converted. Cash payment or subsequent accounting with last preceding orders is not possible. Resale is also not allowed.
